Legal Statement

BJC HealthCare was the first ACO in the St. Louis area.The BJC HealthCare ACO and ACO participants furnishing physician services to the ACO are parties to written contractual arrangements, pursuant to which the participants agree to participate in the Medicare Shared Savings Program (MSSP) and under which participants may receive certain payments related to primary care and other physician services provided by such participants, for which protection is sought under the Final Waiver in Connection with the Shared Savings Program described at 76 Fed. Reg. 67992, et seq. (the "Waiver").

In addition, Waiver protection has been sought for certain written contractual arrangements by and among BJC HealthCare and certain ACO participating physician practices under which BJC, on behalf of its affiliated ACO-participating hospitals, has made donations of certain electronic health record (EHR) technology used to facilitate the exchange of electronic health data between and among providers.
